Trademark Applications.

Our office provides all services for trade- and/or servicemark registrations according to the International Classification as well as copyrights and patents in Aruba.

A trade- or servicemark can be registered within two months from the filing date if there is no objection. The registration date will be effective as from the filing date. The first official publication will follow a month after registration of the mark.

To file an application, we require a fully executed Power of Attorney, duly completed and signed by the applicant. Notarization is required and should be submitted in original at the time of filing. A Power of Attorney is also required for any recordal or renewal.

The term for registration is for ten years and can be renewed for another period of ten years. Be advised that prior or current use of the mark is not required. Non-use of a non-registered trademark for three consecutive years can result in forfeiture of the right of first use. No taxes are levied on TM registrations.

A registration granted in any other country cannot be validated for Aruba. However, as a signatory of the Paris Convention, priority can be claimed within six months from the filing date.
